TERMS OF USE

User Agreement for the Use of the Flash Point Information Portal Services

1. General Conditions

1.1 Familiarization with this User Agreement is a mandatory condition for the provision of services by the Flash Point Service.

1.2 By directly starting to use the services or by completing the registration procedure, the User confirms that they have carefully read and fully accepted all the provisions of this User Agreement.

1.3 If the User disagrees, in whole or in part, with one or more provisions of this User Agreement, the use of the Flash Point Service is prohibited.

1.4 The User undertakes to fully comply with all provisions of the User Agreement throughout the entire period of their interaction with the Flash Point Service and all its components.

2. Parties to the Agreement and Terms Used

2.1 The User Agreement is a unilateral and unconditional document, offered for acceptance by the User in the form of a written offer. Acceptance of this User Agreement is a mandatory condition for the provision of services by the Flash Point Service and replaces all prior agreements and arrangements. Acceptance is automatically carried out by the User upon using the Flash Point Service and the website teus.space. This Agreement is governed by and construed in accordance with the laws of Ukraine.

2.2 "Service" – a software complex (platform) designed to work with content and databases within the Flash Point information service, located on the website: teus.space, intended to solve the User's tasks in the manner established by the Agreement.

2.3 "Website" – the address of the Service on the Internet. The Service is located at the address teus.space.

2.4 "Services" – a set of technical functions provided to the User in the framework of paid or free use of the Service. The Service Services solve information tasks in the field of automotive service, placement and storage of various types of information and materials on this topic, including communication, logistics, navigation, analysis, statistics, making purchases, and other related functions. The acquisition of individual unique properties and qualities of content, functions that allow the original execution of necessary tasks, adding or developing new functions is the subject of this agreement. The volume and quality of Services provided may be changed by the Provider unilaterally without prior or subsequent notice to the User.

2.5 "Provider (LLC "Teus Terminal")" – the entire administrative and technical team of the Service, responsible for its development and operational efficiency, in a single person. The Provider is in direct contact with the User and undertakes to provide informational consultations on issues directly related to the use of the Service. The Provider is one of the parties to this User Agreement.

2.6 "User" – any natural person who, to any extent or in any way, uses the Service. The User is any person using the website teus.space for any of its purposes. Thus, all provisions of this User Agreement apply in full to all natural persons using the website or Service, whether or not they have completed the registration procedure. The User is one of the parties to this Agreement.

3. User Registration Procedure. User Account

3.1 To use the functions of the Flash Point Service, it is necessary to complete the registration procedure, as a result of which a User Account will be created.

3.2 When registering, the User undertakes to provide complete and accurate information about themselves in the form they fill out, and in case of changes to their data, they undertake to update their existing User Account. If the User provides false information or if the Flash Point Service has reason to believe that the information provided by the User is incomplete or inaccurate, Flash Point has the right to block or delete the User's account and may refuse them access to the service functions.

3.3 Flash Point reserves the right at any time, in writing or in any other legally accepted form, to require the User to confirm their data.

3.4 The User's data and information contained in the User Account are stored and processed by the Service in accordance with the terms of the Privacy Policy.

3.5 Login and Password. When registering, the User independently chooses a login (unique account name) and password for account access. Flash Point has the right to adjust the use of certain logins, as well as set requirements for the login and password (length, allowed characters, etc.).

3.6 The User is solely responsible for the security and confidentiality of their chosen password. The User is solely responsible for all actions (as well as their consequences) performed within or using the Flash Point services under the User's account, including cases of voluntary transfer of access data to third parties under any conditions (including contracts or agreements). In this case, all actions within or using the Flash Point services under the User's account are considered to have been performed by the User, except in cases where the User has informed Flash Point of unauthorized access to the Flash Point services using their User Account and any violation (or suspicion of violation) of the confidentiality of their password.

3.7 The User must immediately inform the Flash Point service administration of any case of unauthorized access to the information portal services using their User Account and any violation (or suspicion of violation) of the confidentiality of their password. For security reasons, the User is required to securely log out of their account (by clicking the "Logout" button) after completing their work with the Flash Point information portal services. The Flash Point Service is not responsible for inaccuracies, loss, or corruption of data, as well as other consequences of any nature that may arise due to the User's violation of these provisions of the Agreement.

3.8 Deletion of User Account. The User has the right at any time to delete or partially suspend their account in the Flash Point services. This function is available in the "my profile" section, and the User can also contact the administration in writing to request complete or partial deletion of their information from the Flash Point service. Within six business days, the administration undertakes to delete the User's information.

4. Rights of the Provider

4.1 The Provider has the right at any time and in any volume to restrict the provision of Services to the User in case of violation by the User of one or more provisions of this Agreement.

4.2 The Provider has the right at any time to unilaterally terminate the provision of Services to the User in case of violation by the User of the provisions of this Agreement.

4.3 To limit or terminate the provision of Services to the User, the Provider is not required to notify the User, either in advance or subsequently, or to explain or justify their actions.

4.4 The Provider has the right at any time and in any volume to modify the quality and scope of the services provided. For this, the Provider does not need the notification or consent of the User.

4.5 In the event that the Provider establishes the fact of improper use of the Service, the Provider has the right to terminate the provision of Services in progress to such User, as well as to block the possibility of using the Service for such User in the future by technical measures.

4.6 In order to provide services in the appropriate volume and quality, the Provider collects information about the User.

4.7 The Provider has the right to use the collected information about the User for the purpose of providing Services in the necessary volume and quality.

4.8 The Provider has the right at any time and at their discretion to unilaterally make any changes to this Agreement.

4.9 Any changes made by the Provider take effect and bind the User 30 calendar days after the relevant changes have been made to the User Agreement.

4.10 The Provider is not responsible for materials published by the User using the Service, including cases where the User publishes materials that violate current legislation.

5. Obligations of the Provider

5.1 The Provider undertakes to provide the Services specified in this Agreement to the User, which is expressed in providing the User with the opportunity to use the technical functionality implemented on the Website.

5.2 The Provider undertakes to provide information services of an advisory nature related to the direct use of the Services.

5.3 In case of substantial changes to this Agreement, the Provider undertakes to inform the User using the Website's internal communication tools no later than 3 days after these changes have been made.

5.4 The Provider undertakes to respond to any question related to the operation of the Service sent to the address (hidden) within 20 business days.

5.5 The Provider undertakes to ensure the confidentiality of the User's data to the extent and by means that are technically available to the Provider and depend on their actions.

5.6 The Provider is not responsible for damages incurred by the User, including damages related to the loss or blocking of the Flash Point account used when working with the Service.

6. Obligations of the User

6.1 The User undertakes to unconditionally comply with all provisions of this Agreement.

6.2 The User is required to comply with all national and international laws when using the Service.

6.3 The User is required to comply with the Agreement concluded with the Flash Point information portal when using this Service.

6.4 The User is required to fully comply with copyright legislation when using the Service. The User does not have the right to reproduce, repeat, copy, sell and resell, as well as use for commercial purposes, any part of the Flash Point Services (including content made available to the User through the services) or access to them.

6.5 The User undertakes to accept all consequences of using the Service. The User is responsible for the security of their Flash Point account(s) and the information presented in them. The Provider is not responsible for the blocking or other degradation of one or more Flash Point accounts belonging to the User. The Flash Point Service is not responsible for the User's actions and the accuracy of the information provided by them. The User has the right to consult with the Provider to learn more about security rules when using the Service.

6.6 The User is required to use the Service for its direct and intended purpose. User behavior that potentially or actually causes disruption of the functionality or stability of the Service constitutes a violation of this User Agreement and results in its immediate termination. Contract termination directly results in the cessation of Service provision to the User. In this case, the Provider reserves the right to block any further use of the Service by such User using available technical means.

6.7 The User is required to use the Service reasonably. Excessive and unjustified load on the service that deteriorates or stops its operation for other users constitutes a violation of this Agreement and results in its immediate termination.

6.8 The User is required to intentionally refrain from any actions aimed at disrupting, deteriorating, or stopping the Service's operation.

6.9 The User is required to refrain from any actions that may limit the availability or quality of the Service for other users.

6.10 The actions specified in sections 5 and 6 of this section are performed unilaterally at the Provider's discretion, and User notification is not required. The Provider is also not required to explain the reasons and consequences of their actions for the User.

6.11 The User is required to regularly consult (at least once a month) the User Agreement to learn about all updates and changes to this Agreement.

6.12 The User is required to unconditionally and fully accept all updates and changes made to this agreement. Acceptance of any changes and updates occurs automatically upon the User's further use of the Service.

6.13 The User is required to maintain the confidentiality of their data, including the login and password of their personal account on the Service Website, as well as other personal data transmitted to the Provider.

6.14 The User is required not to use third-party programs, tools, technical solutions, or websites to modify or improve the operation of this Service.

6.15 The User is prohibited from downloading, sending, transmitting, or in any other way placing or distributing service content. In case of using third-party services and programs that modify or affect the operation of the Service in any way, the provision of Services to the User who committed such a violation will be immediately terminated.

6.16 The User is prohibited from impersonating another person or a representative of an organization, company, or institution without sufficient rights, including Flash Point employees, forum moderators, website owners, as well as using any other form and method of illegal representation of other persons online, misleading users or Flash Point.

6.17 The User is prohibited from downloading, sending, transmitting, or in any other way placing or distributing unauthorized advertising information.

6.18 The User is prohibited from downloading, sending, transmitting, or in any other way placing or distributing any materials containing viruses or other computer codes, files, or programs designed to disrupt, destroy, or limit the functionality of any computer or telecommunications equipment or software for unauthorized access; serial numbers for commercial software products and programs for generating them, identifiers, passwords, and other means for obtaining unauthorized access to paid resources on the Internet, as well as placing links to the aforementioned information.

6.19 The User is prohibited from unauthorized collection and storage of personal data of other persons.

6.20 The User is prohibited from disrupting the normal operation of Flash Point websites and services.

6.21 The User undertakes to use the Service exclusively for legal purposes. Any use of the Service for illegal purposes is grounds for immediate termination of service provision to the User.

6.22 The User unconditionally undertakes to publish only information, data, and texts that are not prohibited by law.

6.23 The User undertakes not to use the Service and technical errors, including 'bugs' and vulnerabilities of the Service and Website for purposes of imperfection.

6.24 The User undertakes not to report 'bugs' and vulnerabilities of the Service to third parties. The User has the right to report such defects only directly to the Provider.

6.25 When using the Service, the User undertakes to refrain from using obscene and vulgar language, as well as words and expressions aimed at inciting aggression or hostility for any reason.

6.26 The User is solely responsible to third parties for their actions related to the use of the Service, including if these actions result in violations of the rights and legitimate interests of third parties, as well as compliance with the law when using the Service.

6.27 At the time of using the Service, the User is a capable and adult natural person.

6.28 To use the Service, the User must fully understand all provisions of this Agreement, including all words and all technical terms used in the agreement.

7. Exclusive Rights to Services and Content

7.1 All functions, elements, and objects available through the Flash Point service, including design, text, graphic images, illustrations, videos, programs, databases, and other objects, as well as any content displayed on the Flash Point service, are objects of Flash Point's exclusive rights.

7.2 The use of content, as well as any other element of the service, is possible only within the framework of the functionality provided by the service. No element of the Flash Point service, as well as any content displayed on the Flash Point service, can be used in any other way without the prior permission of the rights holder. The term 'use' includes, among other things: reproduction, copying, modification, distribution on any basis, display in frames, etc. Exceptions are cases explicitly provided for by Ukrainian legislation. The User's use of service elements, as well as any content for personal non-commercial use, is permitted provided that all copyright, related rights, trademarks, and other copyright notices are preserved, and that the name (or pseudonym) of the author/rights holder is maintained unchanged. Exceptions are cases explicitly provided for by Ukrainian legislation.

7.3 The Flash Point service may contain links to other websites on the Internet (third-party sites). The mentioned third-party sites and their content are not checked by Flash Point for compliance with any requirements (reliability, completeness, legality, etc.). Flash Point is not responsible for any information, materials displayed on third-party sites that the User accesses using the service, including any opinions or statements expressed on third-party sites, advertisements, etc., as well as for the availability of such sites or content and the consequences of their use by the User.

7.4 Links (in any form) to any site, product, service, or any information of a commercial or non-commercial nature displayed on the service do not constitute approval or recommendation of these products (services, activities) by Flash Point, except in cases where this is explicitly indicated on Flash Point resources.

8. Refunds

8.1 Refunds are made only from the user's balance, excluding bonuses for top-ups and funds credited as bonuses; if the service has already been ordered and funds have been debited from the balance, refunds are not applicable.
